An agreement was reached between a California bank and the owner of the Union Trust Building, Downtown, which will resolve $3.6 million in liens filed against the owners of the 11-story building, officials said Thursday.
“We have notified all the lien holders that they will be paid amounts due them by this weekend and that should allow resumption of building renovations,” said Jack Norris, managing director of CB Richard Ellis.
Norris said documents were signed Wednesday between the building owner, Mika Realty Trust of California, and the mortgage lender, California National Bank of Long Beach, Calif., that will satisfy all 10 mechanic liens.
“The agreement calls for a full construction loan for the building, which will pay for tenant improvements and work on the building,” he said. CB Richard Ellis is marketing the building to office and retail tenants.
The exterior work will not be completed in time for the G-20 summit on Sept. 24 and 25, but will allow First Commonwealth Bank to locate a office on Grant Street, he said.
California National Bank filed a foreclosure lawsuit in May, claiming that Mika Realty was required to pay bills to prevent the filing of liens or give the bank 150 percent of contested amounts. The bank holds a $34.5 million mortgage on the building. Christopher Reeder, an attorney with the Los Angeles law firm Reeder, Lu & Green LLP, which represents Mika Realty, said it owed the bank $25.8 million, with $10 million in dispute.
Norris said yesterday the bank did not fund renovations for nine months, while it sought more equity from Mika “sooner than later.” The dispute has been resolved, but Norris declined to detail the financial arrangements.
The main tenant in the building is Siemens Power Generation, with about 700 employees.

The long-contested federal flood plain maps were approved by the Town Board om Monday night, after the announcement that at least 130 more homes were removed from flood designation areas.
The board voted, 3-1, to adopt the maps as proposed by the Federal Emergency Management Agency to cap off a nearly two-year effort to fight the proposal that caused increased flood insurance rates for numerous property owners.
FEMA’s maps changed flood elevation levels and put numerous properties into designated flood plains. Once a property is in the flood area, mortgage companies require the owner to purchase flood insurance, which can cost as much as $1,100 a year.
The board and residents have opposed the maps since they were proposed in September 2008. Wendel Duchscherer Architects & Engineers, the town’s engineering firm, was contracted to prepare new elevation maps.
Prior to the vote, Tim Walck of Wendel told the board that FEMA’s representative had accepted the town’s model for the Sawyer Creek and Bergholz areas.
“It looks like about 130 more structures have been removed,” Walck said.
He noted that the new areas included properties north and south of Niagara Falls Boulevard, including buildings on the Crestwood Health Care Facility campus. Since staging the fight, about 750 homes have been taken out of flood areas, Walck said.
Although the original maps were approved, the town’s additional changes this year will be added later.
Supervisor Robert B. Cliffe, who voted against the approval, said the board could have waited a few more weeks to see how the federal government would react to the FEMA mapping process

I screamed as I watched him get hit, go under the front of the car, and I swear I am not making this up, come out the left side, between the front and rear tire,
and come out running to me!
I stood there sure I had been transported to the Twilight Zone. The car stopped and we took him to the vet, but this was 1974 and there was of course no vet open on Thanksgiving Day. When we took King in the next week, he was fine.
Just a few thoughts that came to mind as I prepare to get my kids their first dog for Christmas.

CHOCOLATE retailer Thorntons today axed 35 staff after sales melted over the summer.
Sales at stores open for more than a year fell 6% in the 10 weeks to June 26 — down from the 4.6% drop seen in the previous quarter – - as hot weather hit trading.
The summer is traditionally Thorntons’s weakest time of year, but a stock overhang also forced it to cut prices more sharply than expected.
Same-store sales over the year were down 3.5% as the firm struggled to attract customers. Sales at its Thorntons Direct webiste rose 15.4%.
A review of the business means that 35 staff will lose their jobs in the head office in Derbyshire over the next three months.
The firm issued a profits warning in May when it announced that chief executive Mike Davies would retire in favour of a successor with “specific retail expertise”.
